Terms of Service

These Terms of Service govern your access to and use of dev0 products and services, including the dashboard, Web IDE, MCP server, SDK/API, billing surfaces, Standalone Worker export, and related documentation (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Eligibility and Account Use

  • You must have authority to accept these Terms on behalf of yourself or your organization.
  • You are responsible for activity under your account and for keeping credentials secure.
  • You agree not to misuse the Service, bypass limits, or interfere with security or availability.

2. Service Scope

  • dev0 provides a Cloudflare Workers backend control plane, including Auth, DataTables, Storage, Functions, Sites, Realtime, RAG, Web IDE, MCP, Billing, Standalone Worker export, and Business+ GitHub Push.
  • Features are plan-gated and quota-gated. We may modify, improve, or discontinue features with reasonable notice when practical.
  • Showcase templates and examples are product accelerators, not warranties that a generated app is production-ready without your review.

3. Pricing, Billing, and BYOK

  • Paid checkout is processed by Paddle, which acts as the Merchant of Record (payment processing, sales tax / VAT, invoicing). Your purchase is also subject to Paddle's Checkout / Buyer Terms. Subscription fees are billed according to your selected plan and billing cycle (monthly or annual).
  • dev0 follows fixed plan pricing with generous included quotas. Platform fees cover the editor and control plane — you pay AI providers directly for model usage. Exceeding an included quota does not produce a surprise invoice — requests may pause (HTTP 402/429) until you upgrade or draw down prepaid usage credits.
  • Usage credits and Credits Packs are optional, prepaid, consumable digital goods used to cover overage above included quotas. They have no cash value, are non-transferable, do not roll over (the balance resets each billing period), and are non-refundable once granted or charged. On-demand mode and auto-refill are opt-in per workspace.
  • Team seats. Every paid plan includes the owner seat. On Business and Enterprise, each additional teammate joins via a Credits Pack (one seat plus usage credits); there is no separate per-seat SKU.
  • Function outbound network usage (external fetch() from edge Functions) is plan-gated, rate-capped, and metered as a monthly pool; overage beyond the fair-use threshold debits prepaid usage credits where enabled.
  • BYOK. AI/model and external API usage made with your keys is billed by your provider directly. You are responsible for payment obligations to any external AI/API providers connected via your keys.

4. Acceptable Use

  • You must comply with applicable laws and regulations in your jurisdiction.
  • You may not use the Service for unlawful content, malicious code distribution, fraud, abuse, or rights violations.
  • Hosted sites and functions are for your own application logic. You may not use them as a general-purpose open proxy, an outbound-request relay, or to host content whose primary purpose is to manipulate search ranking or generate backlinks for third-party domains.
  • Programmatic access to the data plane is provided on the API/MCP hosts (for example api.dev0.stream and mcp.dev0.stream) and requires your project-scoped API key; automated access to the human dashboard host or attempts to evade plan, rate, or authentication controls are not permitted.
  • We may suspend access for violations, security risks, or misuse of the platform.

5. Customer Data and Code Ownership

  • You retain ownership of your source code, prompts, configuration, project data, workspace variables, and other customer content.
  • dev0 does not use your code, prompts, or customer content to train AI models. BYOK AI calls are sent to the provider you connect, under their terms.
  • You are responsible for ensuring you have rights to content you upload or process.
  • You are responsible for reviewing and validating generated outputs before production use.

6. Third-Party Services

  • The Service may integrate with third-party platforms (for example: Cloudflare (including Cloudflare Email Service for transactional mail), GitHub, Paddle, and AI/model providers used through BYOK).
  • Your use of third-party services is governed by their own terms and policies.
  • Deploy and git-push workflows depend on external provider APIs (including Cloudflare and GitHub). If those providers are degraded or unavailable, related workflows may be temporarily unavailable.
  • Standalone Worker bundles exported or deployed to your Cloudflare account are operated under your account, configuration, and provider limits.

7. Disclaimers

  • The Service is provided "as is" and "as available".
  • To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • You are responsible for testing, compliance checks, and production readiness decisions.
  • We do not guarantee uninterrupted availability of provider-dependent operations, including deployment, repository push, or external API-linked workflows.
  • Plan limits, rate limits, feature gates, and paywall headers may block or delay actions when usage exceeds the current plan.

8. Limitation of Liability

  • To the maximum extent permitted by law, dev0 will not be liable for indirect, incidental, special, consequential, or punitive damages.
  • Our aggregate liability for claims related to the Service is limited to the fees paid by you to dev0 during the 12 months before the claim.

9. Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate access for material violations, non-payment, abuse, or legal requirements.
  • Cancellation or downgrade may reduce plan limits and can schedule resource archival after the applicable grace period shown in the product.
  • Intro-month accounts: if you cancel during your discounted first month and do not convert to a paying subscription, your projects and account data are permanently deleted approximately one month after the purchase date. Export anything you wish to keep before that date.

10. Governing Law and Disputes

  • These Terms are governed by the laws of the jurisdiction in which the dev0 operator is established, without regard to conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence continue to apply and are not waived.
  • Billing transactions are additionally governed by Paddle's Buyer Terms, as Paddle is the Merchant of Record for purchases.
  • Before bringing a formal claim, you agree to first contact us through the official dev0 contact channel so we can attempt to resolve the matter in good faith.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updates become effective constitutes acceptance of the revised Terms.
